I don't understand how you have c£150 surplus to spend in addition to your (presumed) contributions into your IVA.

Something is not quite right here. Did you declare your full income and expenditure on your I&E form?

Taking on more credit when you are insolvent will likely end positively.

How will you be able to afford the repayments?

You run the risk of the car being repossessed.

I'm surprised you have been offered the credit - does the financier know you are in a DMP?

They will compare the outcome to what they would receive in Bankruptcy so depending on the figures and what you will be offering as an alternative, they may reject the IVA proposals.

You should speak to an Insolvency practitioner to weigh up your options.

If it was a sole debt in her name then stop paying. You might also be able to claim as a creditor in her IVA for the amount of her debt you have paid off, although you have admitted it as out of goodwill.

If the debt was joint, or you guaranteed it then you will be liable for the full amount.

If the car is sold then the HP liability will reduce/be wiped out so your creditors will reduce by the net value of the car.

I don't think that's correct. All of the tax for the years ended April 2018 will be included as a creditor of your IVA...

I suspect they would still have some records on their systems (especially if they have software know as IPS as when you close a case on it the records are still retained on the system). In any event they have to keep a summary of the case for 10 years so may just have kept enough information to answ...

But at least they don't have to pay 'last years' tax bill, which they thought they did. Perhaps HMRC will agree that the IVA wipes the slate again and allow time to pay as if it was the first year.
