You need 75% in value of creditors VOTING to vote in favour for the variaiton. If I understand your post correctly, a variation meeting has been called and so far 100% of creditors voting, have voted in favour of the variation? Therefore as long as the remaining creditors do not vote against the var...

The difficulty is you have decided to put the property on the market before getting approval from the creditors.

Stalling for 3 weeks is a big risk plus there is always the possibility your creditor meeting might be adjourned.

Great, so in essence an IVA company who advertised that I will be debt free in 5 years, now chooses to persue PPI claims in old IVAs, where prior to the Green/Wright case nobody knew where this money should go. Not necessarily 'chooses' - they have a duty to realise the asset for the benefit of you...

I know little about Trust Deeds as I believe they only relate to Scotland however my limited understanding is that the CSA payments will survive the TD so the debtor must continue to pay. Have you passed your information over to the IP to investigate - I presume they should accept information about ...

thanks Lisa for the reply, i think "they" mentioned bankrupsy wouldnt be the best as assests can be taken, such as household items, tv, camera etc That's not strictly correct - only assets with a high value would be of interest. Yes, if the camera is worth say £1,000 you might have to han...

I suspect they have asked the wrong question - remind them there might be PPI on the Catalogue and leave them to look at it, unless your terms state that you must make such claims.

Why are you asking about PPI - does your IVA state that you will submit claims or is your IP supposed to?

I think in your circumstances you should take a strong look at Bankruptcy, rather than an IVA. This is on basis you have no assets (like a property) to lose. Any income contributions (if applicable) will last for 3 years in BKY - many IP firms use standard IVA terms which will mean at least 5 year c...

Just bear in mind that if you die before the IVA ends your share of equity in the property and other assets will likely vest in trust for the IVA costs, interest and creditors so there may not be enough to cover repayment to her.
