Likely to be quite hard - remember that the loan was provided out of other members direct savings and contributions.

Clear Debt previously lost a court case where their interpretation of what an IVA is was challenged.

I have no interest in going over the past in the sane way as MerlinL14 - it would appear that the IVA companies have an interest in doing that instead.

A recent article on Debt Camel suggests that there are indications that concerns exist around IVA being missold. Ultimately the devil will be in the detail but if there are case IVA companies only have themselves to blame - if they were really honest when people were signing up it would put them off...

Under the Insolvency Act all records should be destroyed 6 years after completion certificate provided.

They will need to demonstrate why they now have the legal ability to do this.

I'm sorry but this was a known issue as I was coming out of my IVA a couple of years ago - and if I knew about it your IP should have as well. HMRC started introducing this as an artificial way of enforcing a mid agreement review that effectively shortened the life of some IVA's. With previous cases...

Ask them specifically (or via your solicitor) who their Data Protection Officer is and state that you want this resolved otherwise you will make a formal complaint to the Information Commissioner. Point out that from 25/05/18 the law will be strengthened to deal with inaccurate data and if they drag...

Hope I am wrong (personal opinion only) but the wording seems very similar to other posts across the net promoting them.

Looking a bit more deeply they are case finders and if I am right about who owns them they seem to be struggling.

£8k seems very little to go into an IVA and if you felt rushed into going this that is not a good sign. If you can take some space and as the others have said way up all your options. We were with Creditfix and whilst it worked out in the end (we were transferred to them) would we have chosen them -...

As Cleardebt as the data controller no longer exists and had shown no interest in reclaiming PPI over the intervening years Aperture/DRSP will need to clearly identify what gives them the legal basis to deal with this now, Send the forms back to DRSP stating that you have never consented to your inf...

Sorry - I generally have no sympathy for IVA companies but based on what has been stated it seems that your ex has let you down.

The IVA company is stuck in the middle.

They are introducers only - they will not actually provide the IVA arrangement but will help with identifying if one is possible and which company might help.

Also consider making any PPI claims BEFORE you might go into an IVA.

Anything that you may be entitled to might be enough to tip the balance.

If you go into an IVA you would be forced to undertake a review to see if any PPI could be reclaimed but you will not benefit from it.

Duplicate question. I have answered on the other thread but wonder why you are concerned about them seeing your 'other accounts'? Technology, functionality and rules around it are still new and bluntly IVA companies are coming across as making things up as they go along based on stuff being posted ...
