Additionally you would only be able to trade as Sole Traders - you would not be allowed to be directors in a limited company.

Depending on who you owe the money to and if over a number of companies you could let them decide what route they take.

Agreed - if the figures have previously been accepted then creditors accept them.

CF have been known to change figures down and then include allowances for things such as smoking even if the person in the IVA is a non-smoker.

The 3 year review rule has been pushed by HMRC so it may depend on whether they were also one of your creditors.

This is likely to be standard moving forwards where anyone in an IVA owing HMRC and with significant equity in their house may find it in their agreement.

The records are there - but for most purposes they are no longer deemed relevant.

The credit reference agencies will have them and places like the Landlord Hub will do a deep dive at times.

Looking at their T&C's they appear to now do a continuous credit check - you have to be able to meet the terms of the credit agreement (including a decent credit score) throughout the contract.

May be too emotive - you might want to link it to how the 1986 legislation is not fit for purposes and that it is allowing IVA companies to take actions that may not be supported by the legislation BUT those actions are hard to challenge given the way that they self regulate between themselves.
