if i take some one to small claims court over a car worth £8000 and if i win the court case will the iva take this money

I would imagine it would depend on the circumstances of the case, but, in all likelyhood, yes.

I know someone, a few years back, who was involved in a car accident and received £4k for serious whiplash injury, I mean months of physiotherapy, it was that bad.. Would seem unfair in that type of situation to hand over monies that were from suffering? Was there any suffering in your case?
