Unpaid childcare money

Can a person who owes me childcare which was all paid to her by tax credits to pay me still include this amount in an iva she spent the childcare money and now says she won't pay as she is having a iva but she was given the amount to pay me and spent it herself therefore she committed fraud

The debt between you and her can be included in the IVA. You could take up the fact that she claimed for something she has not paid with HMRC direct -- whether they would do anything I have no idea.
