I am in an IVA

Someone has decided to file a civil claim against me. If I have to pay this how does that work with my IVA do I have to find the money or does it get added to the IVA?

Hi, and welcome to the forum.

Not sure how this would work, but any debts you had should have been included in your IVA.

I think you need to speak to your IP about this.

This will depend on the timing of the issue and the amount. If you were aware that you had a potential case against you at the time of the IVA it should have been listed as a contingent creditor.

It also will depend on the type of claim. If you ran up a post IVA debt and did not pay it your IVA will be in serious trouble. However if the claim is for damages this is entirely different and it may be possible to invite this creditor to join provided the original creditors agree. You should speak to your IP who could advise better with all the relevant information at hand.
