If a creditor doesn't claim??

Hi What happens if a creditor, for whatever reason, does not actually submit a claim during the term of the IVA? What protection do I have in this instance, even after the IVA has concluded?

Basically, I have just had my 3rd annual report from Debt Free Direct and learned that one of my creditors, Payday Loan Company, have not submitted claim even though they are aware I am in an IVA. I have asked Debt Free Direct as recently as last year to contact Payday Loan Company to inform them that they are bound by the terms of my IVA but still they don't claim. I just want to check that I am safe from Payday Loan Company ever trying to hassle me at a later date, as I have done my bit by declaring their loan at my original IVA proposal?

They will be legally excluded from the IVA and can have no comeback against you once the IVA has concluded.

What a shame companies like this are so aggressive when they are trying to collect money from you, and then cannot even be bothered to submit a claim when you have offered them some money!

Thanks for confirming that Melanie and yes quite agree with you that this is a shame. They only represented approx £300 and were by far the biggest pain in the run up to my IVA. Melanie, thanks again your a gem.
