Hi,

Just a query regarding the IVA process..I am using the services of Cleardebt for my application.

The end document has been circulated to all my creditors and only one bothered to vote (it was a no as well!) - it was adjourned for 2 weeks to chase up the others and come yesterday - nothing - no-one else had bothered to vote.

The proposal has been withdrawn so that it can be re-circulatd again.

Is there anything that can be done if creditors don't vote - Im aware it works on 75% majority - but is there any rules which can force it through or any court action which could help?

I need to get this set-up and running - want to get this paid off and need to have the list of Attachments stopped from my wage so we can live!!

Hi and welcome to the forum.

I'm sorry to hear about the problems you are having. I'm surprised that Cleardebt didn't manage to chase up some votes for you.

Unfortunately, if nobody bothers to vote you cannot force them and there is no court action you can take either.

If the new proposal doesn't work then you can always drop back to a debt management plan for a while and try again, perhaps with a different company.

Sorry to hear you haven't had a positive result and there seems to have been some apathy with the creditors on your behalf.

I'm sure Cleardebt will do all they can for you and will answer your questions directly as they know your case intimately. An expert from Cleardebt posts on here so maybe they will be able to get back to you on this asap.

Thanks for the replies, its not a criticism of Cleardebt, just frustrating when its on and off and off lol.

Fingers crossed for next time, really want to get things sorted out and build a better life for my family.
