I am no expert despite being in an IVA for nearly 3 years, but I'm pretty sure that bailiffs can't touch you once the creditors meeting has taken place.

I know that, in my case, once I had started making the £1 token payments to creditors (through my IP) while the IVA was being set up I never heard from my creditors again.

Hi Chrissie and welcome.

First off when you speak of bailiffs, is this court appointed, or are you referring to debt collectors appointed by your creditors?

There is a big difference, hence the reason for the question.

If your creditors have transfered your debt to a DCA, then a visit from their representative is nothing to worry about. Simply explain that your are proposing an IVA. If it is a court appointed bailiff, then this is more serious has they have powers, which a DCA rep does not posses.

Basically once your creditors meeting has taken place, and assuming your IVA is approved, then all pending action against you in relation to your debt is terminated and no further action can be pursued in relation to your debt via the courts or otherwise.

My understanding of bailiffs is that they cannot gain entry unless you invite them in first, either voluntarily, or by leaving a door or window open. They are not allowed to barge past you on the doorstep on their first visit.

However once you have let them in - known as "peaceful entry", they can return and break in at a subsequent visit.

So don't let em in! Whether they say they are court appointed or not. You can never be to sure who anyone is these days and just cause they say they are court appointed does not mean they are.
We're willing to wipe the slate clean, give you a fresh start. All that we're asking in return is your cooperation.

Baillifs can't call once the IVA is agreed anyway.

Check this link out to see what they can and can't do:
