Hi

Just a little query, my IVA was agreed on 16 May this year, a couple of days ago I received a letter from Marks and Spencer which was a default letter for my personal reserve account.[:(]

They are saying that I have defaulted on payments over the last few months and my balance is over £4,000. They are demanding payment of over £1,500 by the 22nd of August.

Am I really expected to make this payment?

No once ur iva is agreed all creditors are bound by its terms. I would call your ip and let them know they will deal with this for you.

dont worry I got a lot of them. It takes a while for info to filter down to the right departments. I sent a letter to the most persistent ones with my ips name and address on and that seemed to do the trick

Me too -

I got letters / statements for about 2-3 weeks after my IVA was approved. I phoned each creditor concerned whenever I received one and told them the situation. Like Becky says - it takes time to filter down. I think - if anyone is persistent - you can send them a copy of your Chairmans Report as confirmation.

I received my last letter 6 weeks after IVA accepted, gave up waiting for things to filter through, faxed IVA acceptenace and original letter back to the number on the letters. So far as worked with the 3 I've received recently.

Pass that letter onto your IP and ask them to respond to you once they have contacted the creditor.You have nothing to worry about,they are legally bound,but sometimes one slips right through the net and escalates,so make sure you get conformation that it has been sorted.

I get a letter from a company called Moorcroft recovery from Stockport. They are a nightmare, I feel I know them like my family they send me so much stuff. I have written to them but they try a different tactic. There should be some thing in force where we can take these people to court if they do not comply to the terms of the insolvency act?
