Can a debt that is already subject to legal proceedings, eg a County Court Judgement, be included in an IVA

Yes, any CCJ's must be included in your IVA proposal, you should continue to pay your CCJ right up until the IVA is accepted. Once the IVA is accepted the CCJ will be overwritten.

Thanks for the info, i'm actually involved in this field from a slightly different position. I run a commercial debt recovery business and one of my clients has a debt owed by a customer who has stated he has initiated an IVA. He has received a CCJ to settle his debt and i needed to find out if it was possible to recover the outstanding sum or not, thanks again for your advice.
