We have our appointment to go Br at the beginning of October. It has been difficult getting the money together to pay for it and I now have car tax, dog innoculations and my son's college fees all due now. I have not paid for council tax and water this month and wonder if they can be included in the Br as I can't pay this all at once.( I don't have arrears on these' only this month is due)

I cannot speak for water, however yes any arrears you have in your council tax should be included. It is likely if you wait and not pay until October you will get a final notice, which will mean the whole year is due - therefore the whole lot is included - out of interest what date are your payments due and have you received any reminders?

when we spoke to citizens advice they told us that if we were in a position like yours eg council tax or water to pay, to pay the council tax(they can put you in jail for non payment of this) but they can't cut of your water supply and arrangements can be made via the water board to pay a small amount monthly to cover any bills or arrears until you are in a financially better position. I am sorry but i will disagree - the debt has to go to court for Council Tax first, then a bailiff must have attended and returned the file BEFORE any committal action.
Which takes months!!

jumping on the bandwagon here!!!
My council tax was due - telephoned them and explained that I was having problems paying - they were not very helpful. Subsequently got a demand from them, telephoned them again and told them my circumstances had changed and that I would be happy to make an offer to clear the arrears, which was declined. I have now had the inevitable bailiff letters - they want me to pay £150.00 per month, told them that I was going BR - not interested!!!! My first payment is due end of October and my BR hearing is 1 October. Any advice please!!!!

I've got the same problem Sue!!!! I'm 2 months in arrears with council tax (long story but living in rented while my house is repaired after being hit by lightening!), so just forgot to pay the council tax. I received a final notice from the council so i phoned and explained the situation and said that I could clear the arrears this month but they said no - it was too late. I would either have to pay in full or set up a direct debit. The only problem being the lease is up in 2 weeks and I am due to move back into my house, so by the time the DD was set up I'd be back home paying the council tax by DD on my own home!!!! I'm just waiting for someone form the council tax office to phone me back.

Zoe, thanks for the reply - both have been recieved and I telephoned them about it. They also emailed me back and told me that it was too late as the bailiffs were now dealing with it.

Hi Zoe, I went BR on 29 August but didn't include the council tax (as I said there was so much going on I hadn't even realised I was in arrears!)

If you are made bankrupt and at the date of the bankruptcy you have arrears of Council Tax (after FNotice stage) then this is included in your order (the full years worth - up to 31/03) therefore i would call the bailiff (out of interest who is it) on the day of your order and state that to the bailiff that you have been made bankrupt. In your case Brasslinctus if you had your summons or Fnotice prior to 29 August this should be included- just forward the council a copy of your order. This will mean no more payments for the rest of the Finacial year.
