Hi
I had my IVA approved on 23rd April, my first payment is due this month, since then I have had no calls from creditors except one from Barclaycard. Today I recieved a telephone call from a debt collection agency stating that they would be coming to my home to remove goods on behalf of barclaycard. I explained that I am in an IVA and that Barclaycard are aware of this, in fact they voted in favour of it at the creditors meeting. The guy I was speaking to stated that being in an IVA made no difference. I have contacted my IVA company today but they are not operating at full service due to bank holiday and are going to get someone to call me back tomorrow. I wanted to know if the debt colletors can do this and what should I do if they turn up at my door?

You are obviously talking to someone who does not understand insolvency proceedings. Let your IP deal with this for you tomorrow. Debt collectors can certainly not continue debt collecting once an IVA is in place.

red, calm down, firstly they can not come into your home without a baillif and a warrant, you do not even have to answer the door to them, if you do answer the door, politely tell them you know your rights, you and please leave your property or you will telephone the police, that is if they show up they like to use scare tactics.
first thing in the morning telephone your IP and inform him of whats going on and let them deal with it, you will hear so many stories off these collection agencies they are not true, where possible get the name of the company and any person you deal with.
under no circumstances let them into your home, no matter how frightened you are, you are covered by your iva and even if you weren't they have no power to enter your home.

I feel better now. I managed to get a name, number and company name so I'll definately call my IP back first thing in the morning.
I can now go on enjoying the bank holiday![:)]

I had someone call at my house, I was terrified but told the man to go away, he said he had come to remove goods. He did go away, he came in a small corsa, what they really want is money not goods. Tell them to go away, I know how scary this is but the law is on your side and there is nothing they can do.

As already posted you are protected by your IVA and these are just scare tactics. Stick to your guns and follow the advice given above.
