My husband and I have had an IVA since May 2006 but have only paid in the agreed amount for just 4 months. I then lost my job and our IP threatened to breach us even though we told him we were struggling. We have been paying him £50 a month for three months now with other days being suspended in agreement. Now he has breached us again saying he has reviewed our case. I am still not able to find a job and he is literally causing so much agro at home. What do we do to stop the breach? What does this breach mean?

An IVA generally falls into default once you miss more than 3 payments, so your IP is really not at fault here simply doing his/her job. As you can only afford £50 per month, following your job loss, then I rather think that bankruptcy proceedings are a better option for you to stop the ongoing hassle.

The purporse of an IVA is to help you resolve your debt probblem not prolong the pain. Do you have a property with any equity in it? If not, then I agree with Debtdummy, you best course of action may be to jack in the IVA and go for bankruptcy.

Then the problem would be resolved once and for all
