hi i was reading one of the questions by somebody on here and i'm just curious as they said they had been threatened with bailiffs ,i thought bailiffs could only come if you didnt keep up payments through the courts , am i wrong ,can they come anytime ? also i was wondering about children and their possesions ,can they take your childrens toys for example playstation or whatever ? i've not been threatened with bailiffs but can imagine how worried this person must be ,i think they said it was virgin who threatened this course of action .I'd be interested to know if anybody has had to deal with this situation ? Also can you prevent action like this whilst you are in the process of setting up an iva ? thankyou

Bailiffs can only become involved in the debt recovery process, if there is an unsatisfied judgement debt where the creditor has proceeded to get a warrant of execution. Some special creditors, such as HMRC, landlords and local authorities do have special legislative powers to also appoint bailiffs, but in my experience bailiff action is actually quite rare.

Hi
Just to add that some debt collection staff threaten bailiffs, attatchment of earnings etc etc when they know only too well that this can only happen via a court order. They basically scare people into paying by using incorrect information
