Hi everyone and a very merry christmas to you all - hope 2008 is a brilliant one for all.

I have a quick question - hopefully someone can help me out.

My ex-partners daughter is unemployed and on benefits (off on long terms sick), was in an IVA which naturally failed due to her illness. She has £17k debt and was paying £260 per month.

Rightly or wrongly, I have informed her that in my opinion her best option is to petition for her own BR. If she does this, being on benefits, she would not have to pay the £485 to do this ---- does anyone have any idea what she would have to pay.

Any help here would be great.

Hi
If on means tested benefits then bankruptcy court fees of £140 are noy payable,so the total fee should be £345

Hi Andy

Thanks for that. As far as I know, she has not been means tested - she is in the process of getting incapacity benefit and income support as well as housing benefit.

To date she has received only one housing benefit payment and has been unemployed since September 2007. No other payments have been received as it seems a lot of "paperwork" has gone missing or has not been received!!!!????? Ex employer and inland revenue are apparently on a go slow!!

Has your neice stopped paying her IVA yet Sue? If not she could stop the payments and use that money for her bankruptcy fees [:)]
