As a relatively new contributor to the forum, would I be right in thinking that creditors will also have access to the site, so asking questions which specifically relate to sensitive and personal details may not be such a good idea? Is it better to keep questions as general as possible?
I would hate to compromise our future success regarding having an IVA approved because of something a creditor had read.
Thanks

Hi there
Absolutely!
I was actually quoted by one of my creditors about something i had said on this site and i haven't given any details other than my first name.
I will however say this forum is for free speech!!!
hope this helps

well, I do believe in free speech! I am going to petition for bankruptcy so I suppose it doesn't matter what I say and after asking a question on another forum and the awful backlash I received from someone I used to know, I don't there is anything worse that can happen to me!!!!
If creditors DO read these forums, I would like to know why I have had virtually no contact from them, considering I have not paid for nearly 5 months! I have moved house but have mail-redirection in place.

Hi blueshoes and welcome,
hi Zoe and Jane
I'm under the impression that although they can read the post and reply, it is against the law for anyone to act on the information in the posts, I.E.. creditor contacting debtor personally is illegal...but doing it by the post that is in then that is legal.
Not an expert and could be wrong so can anyone validate this or put me straight?

I think the thing is Keith that the creditors or some at least are watching the forum and can at least take note of something that is posted, like for instance "I cant go bankrupt, cos of my job" therfore they could vote against the iva knowing there is no chance of bankrupcy and force someone into a dmp. They dont need to directly act they can do it indirectly. Not fair and not nice but nothing to stop them, but I suppose you can do the same by saying the opposite like " I will go bankrupt and that may make them think twice about a no vote as they would get nothing , as Zoe said in another post that they thought she was bluffing about bankrupcy ,they were wrong.
Hope you know what I'm talkimng about cos I dont [:D]

Its like someone else said maybe best to be carful and not put info that gives too much away like meeting dates and payment levels at least until approval, trouble is people need the support on the day of the meeting as they are usually in turmoil, no answer really is there.

its a bit sad that the creditors do this but they must be losing money if people are going bankrupt now much more than when I first joined, I must admit I am so careful about giving personal info now. Sometimes I am much more reluctant to post than I used to be.

that made me laugh adrian, i know its hard, and unfortunately a few posters have been told that their posts have been read, we will have to work some way round it.

Hi Ang
It was me that said about not giving too much information. But like you say people are a bag of nerves on the day and need that bit of moral support they probably can't ask too many friends and colleagues for. Maybe just say meeting before 2pm today etc. and leave it slightly vague.
But lets be honest about this. I have often told my creditors that I submit to a forum and this has met with approval on occasion. They at least know that we will discuss IVA vs BR vs DMP which I get the distinct impression they don't believe happens with every company putting someone forward for an IVA proposal. Often they want to know that we understand the implications of an IVA and as Melanie has repeatedly pointed out, they will make decisions based on their own criteria and if it gives them the best outcome.
This forum is about free speech and if somebody is having a particular hard time from a creditor they should report it on here.
Regards
Dave

Hi
I think that you need to weigh up what you gain from this forum by asking questions and discussions to what you may lose by creditors reading posts, identifying you and acting on the info.
I think that it,s only been poor Zoe,s case that has been affected by using this forum,so don,t worry too much about it.
