Dear all,

Reading in this forum and my personal experience I am inclined to think that there un curtailed enthusiasm on their part to persue the debter with out giving a fair chance to debter to come to an arrangement by IVA.

In my case as soon as I informed of me seeking an IVA,American express expressly nstructed Brachers to issue default notice,demand for full payment,cort claim and a ccj,with in a span of 3 months.

I am aware at least one such case where a charging order was obtained.

By reading on this forum,I gather of the iconsiderate way that the debters are treated by American Express and Brachers.

I am sure there must be a way of complaining about their unsympathetic behaviour.

American Express was one of my creditors as soon as I told them I was going in to a IVA I had a letter with in a week from their goons at Brachers telling me they were starting legal procedings to reclaim their money. Luckly for me my IVA was finished before they had the chance to do any harm. They were the only creiditor who voted for my proposal out right and I did not even owe them that much. So I do not have any time for Amex these days. I think they are allmost as bad as NR when it comes to debt.

Dear all,

In my case my IP took a long time to process my IVA proposal,about three and a half months.

It is a pity that some IPS take such a long time to process things.For them we are just another case for us it is life and death.

It's true that Amex are a difficult company to deal with and were my only credtor that voted no.
I suppose from their perspective the debt was built up in a relatively short time as it is a charge card that must be cleared each month and so they feel that we must have known that we would have difficulty in paying it.On the plus side there debt is normally low compared to others so they do not have a deciding vote

Mine was two credit cards with american express and not a charge card,hence it was built over years.

Hi, This is my first post and I just wanted to say that I had my iva approved in August- and what a relief it was to me! I wanted to say that I had three amex cards! (one being the chargecard), They didnt vote at my creditors meeting but fortunately the other creditors did vote for my proposal (except capital one) and thankfully it went through ok regardless of Amex's decision

I have a credit card with Amex and am now 1 payment (soon to be 2) behind.
I have spoken with them on the phone and explained I have lost one of my jobs and having difficulty and was taking advice on what my options were (didn't mention my proposing and iva). They were very nice on the phone wishing me luck and everything.
Now today my lovely postman (even though i dred him calling these days!!!!) has delivered a notice that they intend to proceed with a default notice unless I pay arrears within 14 days.
Might ring them to thank them for there patience and understanding!!!!

A default notice is necessary and will be served sooner or later. Really, it is nothing to worry about - it can be remedied. But as you are aiming for a DMP or IVA?? etc then it is immaterial as you will not remedy it -pay them as before with the arrears and charges.

A termination notice would be served later to terminate the account before they can do anything more like making some material threats to get their ££ back.

By that time you would have a plan in place to sort out debts.

I won't even waste money calling them in the mean time.
