Hi I am a married uk resident living with my wife,I have 4 visa cards al up to limits of ,5000,400,600,500 and a catalogue debt of £2500 so all in all £9000 all in my name only. I have been struggling with minimum payments for last few years, I am currently out of work and suffer from stress and my partner is working and just managing to pay these minimum payments. This is causing alot of strain on her and I am looking to go bankrupt. What I need to know is if I alone apply for bankrupcy solely on my debt, how her wages or her expendible income will be raken into account wether she has £20 or £400 left after paying rent, council etc. household bills. She has been keeping my payment up for last 3-4 months leaving her nothing. Please let me know if her income will be taken into account. I am unable to cliam any benefits at present due my wife working. Thanks Neil

Are you a homeowner ?
In bankruptcy it will only be your income that is taken into account

Hi Neil,
I believe that your wife's income will need to be viewed as this is the only income coming into the household, as you are currently out of work I dont believe that your wife will have to pay for your debts. The decision is ultimately up to the OR but you may not have to pay anything as you are out of work.

You are not a homeowner if you are paying rent, so in bankruptcy as Andy says you have little disposable income which would be available to enable you to have to make ongoing contributions. Your wife's own income will not be taken into account.

Cant you het incapacity benefit or jobseekers allowance .. these are contributory benefits not based on your wife's income ? just a thought

Hi there,
I have tried for contribution based jobseeker allowance. But not enough paid in due no my very patchy unstable job history. But I am always hoping to get into a job I may be able to handle and have not looked into incapacity as I was on it a few years ago and found it very hard to get out. But not really sure with not paid enough stamp anyway.
