Apologies if this has already been asked.
My hubby recieved doccuments today stating that after being in the iva for 3 years, the total creditors claims are £27.332 leaving £33.007 of claims not yet made to date. This is all very confusing.
Are these outstanding creditors likely to pop up a the variation meeting if they havent made a claim in the 3 years? Are they allowed to? what happens if they dont?
Sorry if that makes me look dumb.

How strange for your husband's IP to not have agreed such a high number of claims after he has been in his IVA for three years. Are these trade creditors or banks? The IP should have really got to grips with this at a much earlier stage, chased the creditors and given them a final opportunity to claim or else they be removed fro the dividend. I normally do this by the end of the first year. As you are offering a full and final settlement, it is important that this issue be resolved as soon as possible, as it will directly affect the amount of money he needs to offer.

Thanks Melanie, i also thought it strange how after 3 years they havent made a claim when most of that is owed to one bank. I did enquire about it and the fact that we lose the mortgage offer in december. She told me it should all be dealt with by then and they would now be asked again to make a claim. Luckilly Andrew Graveson is going to send my solicitors doccuments back and get them on "stand by". Hes going to speak to them and tell them by no means complete without my express permission.
Hopefully we wont run out of time. Just waiting now for date for variation meeting.

Why not get Andrew to have a word with your IP - he has much experience of the insolvency world, as well as being one of the best mortgage brokers I have come across, and I am sure will sort this is out with just a couple of phone calls.

The problem is, as i have said before, my hubby's IP is a bit of an enigma. Everything now is done via email to a lady who must deal with his cases. She says hes rarely in the office. To her credit, shes been brilliant. She answers emails within 5 minutes.
I would happily give her email address to Andrew if that would help.
I have to say to you Melanie, thanks for recomending Andrew to me. Hes been nothing but brilliant all along. I have harassed the life out of him with questions and he doesnt mind [:D]
Its bothering me slightly about these unclaimed creditors as potentially they could be the cause of us losing the mortgage offer. If we had to start again with an even higher rate, i dont know if we would be able to do it.

Have had a word with the lender concerned; if the need arises I think they'll extend the offer by 14 days.
