Is there such a thing as miss-selling of IVA's? I am worried about my daughter. She has never managed to get herself out of debt since she went to university. She investigated an IVA and they told her to include her student loans as part of her total debt, even though she was not earning enough to start to repay them.

Could this have been to get her debt over the magic £15,000 figure? She actually negotiated the agreement when she was off sick from work recovering from an operation.The company subsequently sacked her when she had to take longer to recuperate than they wanted!

So she actually signed the agreement when she was unemployed.

It is normal to include student debt if they hold less than 25% of the total unsecured debt.

Hi Sue ... just wanted to say welcome to the forum. My student debt loans were included in my IVA ... it's just that I think they have funny views on IVAs and tend not to vote. But the experts here will know all the ins and outs ... we have had a few threads regarding student loans before ... they are lost in the subsequent myriad of posts now I expect.

Sending lots of good luck for your daughter in finding a solution to her debt situation ... and good on her for disclosing her situation to you ... so many of us sit and worry and keep it all to ourselves, especailly the youngsters.

All debts should be included within an IVA proposal, regardless of the views of the particular creditors concerned, and Student Loans are no different.

Was your daughter's IP aware that she had lost her job, and what comment did they make, and how is she managing to fund the payments?
