Hi

My husband and I failed our IVA in June 2008 with debts of £44k. 90% of them are joint. I also have some debts in my maiden name.
Can I declare bankruptcy alone for my married name and maiden name?
My hubby is an Accountant so bankruptcy isn't an option for him.

I was wondering if I can declare bankruptcy to clear my debts?

As far as I'm aware you can declare BR for yourself, but your husband will still be liable for any joint debts.

Hi Charotten

Wait for other answers as I am not a techie. You can file for bankrupcy on your own but any joint debts your husband will more than likely be pursued . I would get some good advice from an Ip or someone like andy davie or Paul at reviva on solutions for a way forward.

unless you are now separated from your husband there seems little point in declaring Br if the outstanding debt ( 90% of 44K ) is still outstanding.

The only benefit to you would be that nobody can chase you personally anymore so there would be some stress relief but the problem is still there.The consequenses may well outway the benefit.

It would be good to know how long you have been in the IVA, how much the monthly payments were and what has actualy been paid off.

If hubby is unable to go br then I would suggest that you review the whole situation and see if a Bespoke solution can be created that would work for everyone.

perhaps you should speak to a bespoke solution provider for a confidential chat to try to get a strategy moving forward.
