hi i am thinking about an iva, please can you tell me, if i have a debt in both myself and my husbands name, would they still go after my husband for the debt, if i go into iva and put there debt on my list.

Yes, you are both liable for the debt so your husband would still be chased for the full ammount if the IVA was only in your name.

As mrs s says if only you entered an iva hubby would then be liable for the debt.

I have IVA in my name, our bank decided to chase my wife for the full amount on our overdraught, despite her having no income. She has a 56 year payment plan with them believe it or not!

Does your husband have other debts as well as the ones he is jointly responsible for? And if you were to enter into an IVA, would your husband be able to afford the ongoing contractual repayments to this creditor from his share of the disposable income?
