Hi all

Still not found a job, I'm trying everything. Only getting about 1-2 days a week agency work. Have even looked into different types of work but theres not alot else i can do other than drive HGV.

Creditors have not received payments from me since June and they are not very happy. I have wrote to them to explain my situation but they just seem to request I&E but that should be pretty obvious.

I am starting to fall behind now on utility bills. My OH wages just about covers the rent and general living expenses but thats about it. Only 1 month behind on most bills but that will soon be 2 months if i dont find anything very soon.

I cant even look at bankruptcy at the moment...where am i meant to find the £500 fee from?

it is not possible to ask anyone for help as family and freinds are not in a position to.

What am i meant to do?

I am so sorry that you are still yet to find employment - and given the circumstances you do need to make sure that you are claiming the full amount of state benefits you are entitled to. Do check to see if you can get any assistance with your rent and council tax, via housing benefits - and make sure that you deal with your priority creditors such as your rent and council tax first. The others can wait until you get yoruself sorted out.

If you are unemployed, the cost of bankruptcy will be reduced to £345 as you will get relief from the Court fee - so that might be of some assistance.

Hi Melanie

The problem I have is that I could have agency work any day of the week and this is going affect what I can claim? If I claim everything and then suddenly get some agency work, then surley I wouldnt be entiltled to claim? But then the work could stop as quick as Ihave stopped the claim!

It is a difficult situation to be in to be sure - but better to have claimed and then need to stop the claim than not to have claimed at all! (Gosh that sounds a bit Shakespearean!!)

Thanks David, I was so close to my creditors meeting with your company but got made redundant a week before. Very bad timimg and nothing has improved!

There are several utility companies which will provide funding for their customers to pay for bankruptcy proceedings, and your local CAB will have details of the ones which may offer this in your area. Worth a call if you beleive this is now a better alternative than hanging on for employment.

I would preferbly like to hang on for employment and enter the IVA route but what are the creditors going to do in the mean time? they have not received any payments since my redundancy

There is not very much that they can do, unless you have a property with equity in it which could be attacked by charging orders. The best thing to do is to keep them informed, and I am sure that ClearDebt will be able to help you with this in the meantime.

There is no property. I guess i will just get CCJ's thrown at me in the meantime. Dont have nothing to do with Ceardebt anymore, they dropped my proposal [understandably] but no response from an email i sent a few weeks later.

I will just have to take all they throw at me. at the end of the day I have no money

Steve, if you don't mind me asking why are you so against BR? Apart from the fees of course! It would give you a fresh start without the worry of your debts and your creditors hassling you.

If you want my honest answer Skippy, I dont want my name in the paper and i certainly dont want my landlord to find out. He is very funny and worries if the bank delays the rent by something silly like one day.

He wouldnt let us stay here regardless of the fact that we have never missed a payment in the 2.5 years we have been here

He would think that me going bankrupt in this address would have an adverse effect on him? Would it? I dont know....
