I have been in a n iva with my husban. We split 2 years ago and he took on the iva as i had the children to look after. Now he has gone bankrupt and i am being chased for the money. How do i find out what was in his bankruptsy and what was not? How do i find out what i owe and to whom? I am paying off the fees to the iva company but they are not on my credit report. Is this correct?

Hi Sharon and welcome.

Was your IVA a joint one, or interlocking? It could well be that the IVA failed once he was made BR.

If you had joint debts, then once he went bankrupt his half would be written off, but you would still be pursued for the whole amount (I think that's right).

Have you spoken to the IVA company to see whether or not your IVA is still up and running, and what is happening to your money?

I would also check on the insolvency register to see if you are still listed on there.

As Jan says it is vital that you speak to the IP immediately. Request a copy of the original IVAs and any annual reports. This should show who is owed what and how much has been paid in and out.

It may be possible to vary the terms of the original proposal[s] where your debts which include the joint debts are split into a separate IVA and your ex husbands are dealt with in his bankruptcy. However, given that you have the children and the idea was for you not to have to pay, bankruptcy may also be your best option. Thsi would of course depend on your personal circumstances such as income and expenditure and list of assets.
