to cut a long story short my wife and myself have a joint account with halifax
this was inculded in my accepted iva proposal
today though my wife has recieved a bank statment with overlimit charges on it and interest added .
the sinister thing is my name has dissappeared off the account but the balance is increasing
i will speak to my ip tommorow about this
anyone else had a similar problem ?

I think they will still be chasing her as its a joint debt so technically she will still be liable for the full ammount.

so this debt shouldn't have been included in my iva proposal ?

Yes it should have but untill the whole debt is repaid in full, im afraid your wife will still be liable as its in her name also.

An allowance should have been given for your wife to service this debt each month.

sorry im a bit confused does this mean halfax will get the full payment of the O/D from my wife plus 26 p in the pound off my iva ?

NO, they will only get the ammount owed to them. Some from the IVA and some from your wife.

Hi
Their claim in the IVA will be reduced by the amount that your wife pays, your other creditors will recive a slightly higher dividend.

Surely this was considered by your IP at the time the IVA proposal was presented? Were they aware that the debt was joint? Is your wife contributing to your IVA payments at all?
