i am currently in an iva one of the creditors that didnt vote is threatning me with court action can they actually do this as an iva has been set up they have sold this debt to another company i have told them i am in a iva but still keep hassling me

morning k and m's-hope youre ok.
im no expert but from what ive read from the experts posting is that if this creditor was included in your proposal but chose not to vote i dont think they can touch you and will be wasting their time and money trying to get you to court-hopefully one of the techs will be along to correct me should i have made an error ! [:)]
Also is this debt theyre chasing secured or unsecured ?

If this creditor was included in your IVA then as FD says there is nothing they can do. Contact your IP and get them to speak to the creditor.

There are a lot of companies who do this, let them instigage court proceedings - they are the ones who will end up with mud on their faces, plus it could cost them money.
Tell your IP, but if they phone again, I'd tell 'em to bring it on!

This has probably resulted from a communications error within the creditor's administration department and is nothing to worry about. Let your IP know, and ask them to deal with it for you.

Either write to that particular creditor informing him/her that you are in an IVA - give them your IP's name and address and copy your IP in with the letter OR write to your IP and request that he/she writes direct to the creditor.
