I entered into an IVA 5 years ago. Last year my husband commited suicide and I asked my insolvency practitioner to contact my creditors to get a vote on whether they would accept 4 years worth of payments as settlement. They voted in favour and my IVA was settled in January 2008. Today I received a letter from Fredrickson International Limited who are attempting to recover 275.01GBP of a debt that was part of that IVA. I''m in such a state I don''t know what to do. Are they allowed to do this?

Hi there and welcome to the forum. I am so sorry to hear of your husband's death - what a terrible event for you to deal with.

I feel sure, from the facts that you have presented, that this creditor were fully bound by terms of your IVA, and that they cannot come after you for the remaining debt. But the very best thing you can do is refer this to the IP who acted for you, and I am sure that they will be happy to set the record straight for you.

I hope that 2009 brings a better year for you all round.

I am so sorry to hear about your husband - what an awful time you have had.

Do you have your certificate of completion? If your IP can't help you, maybe you could send them a copy of that.

This is the last thing you need on top of the tragic loss you have suffered.
Have you tried ringing them to explain that your IVA is now settled?
Try not to worry, if it was included in the IVA theres nothing they can do to you.
I agree with what Jan has said about the completion certificate. If you have it send them a copy along with a letter explaining and ask them not to bother you again.

What a worry receiving a letter like that, after all that has happened.
Rest assured that they have no claim as the debt was dealt with in the IVA.I am sure that your IP will write to this company as soon as you let them know.

Sorry to hear of your circumstances. No one can claim from you any monies in respect of your post IVA debts. As indicated either write to the creditor concerned informing them that the debt was part of your IVA and to stop hounding you. Or as indicated get your previous Supervisor (IP) to write to them. Thank you all so much for you kind words. I've contacted the company involved and they've asked me to send a copy of the original IVA showing the creditors involved and the certificate stating that the IVA has been settled. I have these items and will be sending copies straight away. It's been a hard 5 years for me and my husband but we were determined to keep up with our IVA, which we did. Losing my husband was the worst tragedy I'll ever have to endure and I was very grateful to my creditors for agreeing to settle the IVA after his death. I've been coping quite well on my own financially and feel I can see a light at the end of the tunnel to one day be debt free. It was just a shock today getting that letter and I wasn't thinking rationally. Receiving your advice made me take a deep breath and deal with it!
