Hi everyone, I haven't been on this site for a few months, but I gained some very useful information and advice about 4 months ago. Our IVA was approved about three months ago. Our IVA is managed through Blair Endersby which is the IVA arm of Baines & Ernst. Originally our management plan was with B&E so it made sense to go over to the IVA within the same organisation. Anyway, the reason I am posting is because Blair Endersby called us just before Christmas requesting our paymnet via debit card as the direct debit had been cancelled. We were sure it wasnt but gave our debit card details and agreed the next direct debit to be collected would be end of Jan - well not only did they have the card payment but also collected the direct debit which has left us without any money since Monday - I am hoping it will be in our account tomorrow but I have written a strongly worded complaint to the B&E which will be posted tomorrow and I will also be contacting the FSA. We are really losing confidence in B&E - are we able to transfer the IVA to another company or is it a case of suffer with B&E over the next 5 years?

Hey Mike, I can understand you being mad. You can't change IPs, hopefully this was just a glitch and they won't make any more mistakes.

I'm sorry to hear of your problems and hope your money is put back soon.

Unfortunately, you will have to stay with B&E for your IVA as it is nigh on impossible to change firms.

I thought as much but thanks for confirming. My wife and I will have make sure we have are on the ball with any dealings with them in future. I assume the FSA is the governing body for IVA firms?

Sorry - but is is nigh impossible for you to replace your Supervisor, without a Court Order for which you need a very good reason, and would be expensive. This highlights the need to get the right professional acting for you in the first place, and sometimes shopping around until you feel comfortable with a provider makes good sense. As a tip, if you do not end up speaking to the IP themselves, you have to question what sort of service you are going to get in the long run.

Must be a mistake and I am sure that it will be sorted out fairly soon - I'll chivvy them up as one of their representatives sits on the DRF Board.

Did you get the refund? Are there any other reasons you are losing confidence? IF you contact me with the details of any issues these can be looked into.

You can always instruct your bank to refund the money under the DD guarantee, if you do this it should be back in your account the same day.

Thanks for the replies, its really appreciated, I have just sent an email to the Blair Endersby posting on this, thank you for geeing them up, as still waiting for the refund. My Wife contacted her bank as the payment comes out of her bank, she was told that she would have to go into the branch fill out a form and the refund would take 2-3 weeks to go back in to her account????????? I didn't think was right as with Nationwide, one simple phone call and the money is back in the account within a couple of hours at the most!

I don't know which bank you're with Mike, but my partner had a problem with Natwest when a DD was reinstated. They said they could help, but it would be quicker for him to go through the company who reinstated the IVA. He did this and it took weeks for him to get a refund, and it came in the form of a cheque so he had to wait for it to clear as well. I would insist that the bank deal with it under the terms of the DD guarantee.

Good luck with getting this sorted out, I hope you get the money back quickly.

Thats what I am worried about waiting for Blair Endersby to refund it, the bank in question was Halifax. With Nationwide, there was never a problem and it would have been refunded within the day, normally within hours. Hopefully today will have better news.

As to complaining about this service from Blair Endersby, can I refer them to the FSA ?

No their professional body - ie who is the IP and it will be his regulated body - but it appears that Blair Endersby is onto your case!

You can refer the complaint to the FSA, I think so long as your IVA was accepted after 1 Jan 07, but as David points out the IP's regulatory body is probably the best port of call. I am sure it will not come to this hopefully!
