Hi

I have a question for the experts i think.

My wife is just about to start the legal process to gain power of attorney over her father's affairs, as he has mental and physical disabilities following a serious accident.

Do you know if she will be granted 'control' over his financial affairs as we are both in IVAs? I understand that we would have a problem if she was bankrupt, but I can't find any mention of the position of people in IVAs with regard to gaining POA.

Thanks

Dave

Hi there and welcome to the forum

There is no bar to your wife acting as Power of Attorney to assist her father.

I am a bit worried about this as my father has made me Power of Attorney in his will, he is ok at the moment, he is thinking of the future, he does not know however that I have been bankrupt, would this affect things? I am discharged now [?]

I'm an executor in my uncle's will and I've been BR, but I don't think it's a problem.

It doesn't affect discharged bankrupts from acting in this capacity.
