We started an IVA four years ago, but we moved abroad and eventually couldn’t keep up with the payments. The IVA failed after one year, and our creditors voted on not applying for bankruptcy, because of our location and the costs involved. Since then we haven’t heard anything from any of our creditors. We moved to a new address some time after that and in fact now we are in a different country again. All through this, we have kept a UK bank account (they weren’t involved in our IVA) and have kept our address with them up to date.
My question is, what happens if we return to the UK? We haven’t lived there for 4 years, we have no house there, so is it true we can’t apply for bankruptcy ourselves? Will our creditors know that we have come back? What will we have to do?
