Hi All

Still in the early stages of an IVA. Had a email from egg today saying they were pending legal action against me in the from of a CCJ. Informed them earlier that a 3rd party was dealing with my debt. Will phone them tommorow. But what if they want me to set up a payment plan? should i do it knowing I will not be able to meet payments? Any advice would be appreciated

cardtart if you are in your iva they cant do a thing its empty threats take no notice. if you are just going into your iva and it hasnt been negotiated yet then just continue to inform them of your intentions and update them regularly your going into an iva so that would come first your doing the right thing i had the same problem as you and they never did anything.

Also get your proposed Nominee from the IVA firm to contact them - but do not set up any sort of arrangement with them direct. Who is your proposed IP?

If they do go ahead with legal action before your creditors meeting, your IP can apply for an interim order to delay any court hearings until after the creditor meeting. If you are approved, then they can't take action anyway.

It is standard practice by egg so I wouldnt worry about it.
