just spoke to MBNA regarding a letter they sent regarding default and threat of legal action, gave them a courtesy call and explained that we were in the final stages of entering an iva and creditors meeting should be in around 14 days.
Ive gotta say he was extremely polite and understanding and in fact complimentary of our choice of iva company.
Were with Melanies team and i find his comments encouraging.I know there are some horror stories but i feel it only fair to give credit where its due.

It would be nice to think that MBNA are changing, but I won't hold my breath! It'll be interesting to hear how other people get on.

David Mond, on behalf of Cleardebt, is currently embroiled in a legal battle with MBNA and is seeking a declaration from the High Court that they are in breach of the IVA protocol and they have until 8th Sept to respond, having been given 4 extra weeks.
Regards.

They often get bad press on the forum, and do have quite rigid criteria which is well known, but I will be very interested to learn the outcome of David's action - given that the protocol is a voluntary rather than mandatory code of practice.
They have been very helpful to one of my clients this week, and fingers crossed they may have changed their minds about their reasons for rejection, so I find if you talk to them sensibly you generally get a sensible decision.
If David's action is successful, this will open up IVAs to people who are being turned away due to not meeting criteria.

Hi
Will be very interested to hear how David gets on. I can't imagine MBNA will change as I have said before worst of my creditors who still keep writing to me 5 months into IVA.

my proposal for IVA has been rejected and MBNA are the only ones who have refused, DFD say they will recirculate the proposal so keeping my fingers crossed. dont know what to do next.

Have they told your IP why they are rejecting mfne? Is it because of the 10 year DMP ruling they operate under?

Hope they do re-consider their stance on the 10 year repayment calculation.

Hi
I am often amazed at the credit levels and exposure that MBNA have in the market. It is not uncommon for people to have 15k credit levels, I think their lending has been questionable and this may be the reason for them playing hard ball with regard to IVA acceptance

Horrid company to deal with, still getting calls and post even though my IVA is now in place and they have ben told verbally and in writing around 5 times now! Luckily I no longer have to deal with them.
My story with them was I started off with a £1500 limit. Yes, I should have been more sensible with my use but even though I was paying minimum payments for ages they kept increasing the limit, sending me blank cheques and increasing my limit until it got to £8900 and almost used.
In my book yes am responsible for my borrowing but they were IRRESPONSIBLE for increasing limites EVERY few months

Hi
My story is the same as yours essexmat. Like you I agree I know I am resonsible for my borrowing but increasing limits and sending credit card cheques does not help.
I am glad I will never be in that postion again.
