Hi everyone, its been awhile since i last logged in. I am now 1 year into my Trust Deed and I am also 41/2 months pregnant with my first!!!
Things are looking good, my boyfriend bought us a new house in the country, we now have a beautiful black & white Cocker Spaniel called Mackie and a Yellow lab called Gus.
I have come across a problem in the last week or so, my mother has disowned me and my brother, i dont know why really, she is an alcoholic and has mental issues, neither of which she will get help for. She demanded yesterday that i pay back money that she gave me as birthday presents etc between 2000 and 2005 supposedly totalling £5000. Its very far fetched to say the least, especially as £2000 was money repaid to me that she stole from me when i was 16, money my grandad had left me when he died.She has threatened legal action if i dont pay but i fail to see how, as there is no loan agreement or proof any money was given to me. Regardless of this, my Trust Deed (Scottish IVA)which i had to take out in September 2008 will protect me from any legal action trying to claim money from me wont it?

Hi PinkDog and congratulations on your pregnancy.
Unfortunately I do not know what the situation is in Scotland but you would have protection in an IVA. Regardless, presents are effectively that and cannot be requested back years later. As you say there is no loan agreement or any evidence of monies being borrowed so I would say she has little or no chance of winning any court case.
My guess is she sees that things are looking good for you and she is hoping to squeeze some money out of you to fund her addiction but I would doubt if she would get far in court. If she has genuine mental health issues I must admit to having sympathy particularly as she will have a grandson or granddaughter by the summer and she is risking losing any contact with that child.

Pink Dog I'm sorry I do have the answer but would like to say I'm sorry this is happening to you and hope it doesn't spoil your otherwise very happy life. Fab news about the pregnancy and I'm sure you're enjoying your doggies.
I hope someone with some knowledge will be along soon.

I'm sorry things aren't working out well with your mother, it's at times like this you could do with her support.
She hasn't got a leg to stand on with regard to any money she has either gifted or loaned to you.

thanks everyone for your answers. I will be sure to let you know what we have. Does anyone remeber my horse Major? he was under threat from creditors for a while, well, he's now been officiially declared useless! sad as it sounds it has saved him from the meat man! he is suffering severe arthritis in most of his major joints and has been retired at the age of 11. He is happy enough plodding along beside me though, so as long as we have each other, it will all be good

I thought I recognised your name!
I do remember Major, and the problems you had at the time of doing your Trust Deed.
I'm so glad (for both you and him!) that he has been declared useless, although we all know he is far from that.
I'm so glad he is doing ok and is happy enough. I hope you have many more years with him.

Glad to hear that you are doing well. I often wondered what had happened to you and the Major. Sad to hear of his illness, but glad that you have managed to hang on to him. Good news about the baby too!

it turned out that the lameness he suffered last March was the start of the arthritis. He is well enough now to graze quietly in the field and enjoy a leisurely life, thanks to my very loyal vet and my insurance company. We have given him the best of the best as treatment goes so fingers crossed he stays well.
My Trust Deed is going well, im 12 down 24 to go! I managed to speak to my practitioner who advised me that even if i had a ligit signed loan from my mother, it would still have to be passed through my Trust Deed so its looking better every minute!

It's good to hear from you again Pink Dog, and congratulations for your pregnancy. I'm glad things have worked out well for you and your boyfriend, and I'm so glad Major has been declared useless - I mean that in the nicest possible way of course!
I'm sorry you're having problems with your mum, but I'm glad that your IP has been able to put your mind at rest.
