this is an email I got back after many emails I sent the council tax
as they advised me to continue making normal payments after I tried to negotiate a payemt plan to repay arrears , only to be told after I paid about £1400 , that i had paed back arrears not this years council Bill !
letter from council: I been arguing the case with them that the arrears should be part of my iva please advise if they are right thanks :

Council Tax arrears can not be including in an IVA. Please see the below extract from
http://www.iva.co.uk/guide_starting_an_iva.asp :

Which Debts Can’t Be Included?
Some debts cannot be included within an IVA. These will normally involve secured debts, such as a vehicle HP or Mortgage arrears. Other debts such as Rent and Council Tax arrears and fines (such as parking offences) will normally have to be paid and provision for the repayment of these debts will be made separately.

Therefore, your arrears would not be covered by the terms of your IVA, whether they are pre Aug 2008 or post Aug 2008.

When did you start your IVA, and what dates do the arrears relate to?

Arrears on council tax are a debt that should be included in the IVA. You should not be fighting the council but your IP should.

my iva started aug 2008 , 90% ofthe arrears realte to pre aug 08 , but they first started saying that beacuse the arrears wernt relalised till after aug 08 they dont count to be pre au 08 arrers but of present time ? confusing to me , as they didnt say nothing until all arrers were paid off where i was assuming i was paying present council tax , then all of a suuden they took it to court saying I owed al of 2009-2010 payments and applied attachemnt of earning , taking a wacking £550 last month then another £400 to be taken this month

thanks for eplies , if your saying council tax should b eincluded , then whay have they qouted that ref to IVA and council tax ?

Nice that they have referred to this site for the quote
Council tax arrears can be included in an IVA,as Michael states. Speak with your IP as they should be sorting this for you.

Hi Helen. You didn't sound bit**y and I have very thick skin anyway. It may be that there were some small arrears and an allowance was made to clear them but in general council tax debts should be included as otherwise it would be a preference.

Our council tax arrears were included in our IVA. x

Please can someone give me a link as to whre it states that council tax arrears should be included so I can rebuke their quoted statement , i dont really want to unsettle my iva as i been into it for 18+ months now and council have taken the money from my wages ! via attachement of earnings , I pleaded with them to at least spread it they wouldnt , so now I want to get back what they taken and pay them what I should have .ie % of it .
