Hi,
I took out an IVA and it has been paid and I have a certificate of completion, but I keep getting letters from debt recovery people, most of them go away when I send the completion cert, but one company will not give up, saying they have no record of getting any payments! I have sent the completion cert, the same company have already closed another debt when I sent the cert, I don't know what else I can do? Please help, I thought my nightmares were over!!

Hi and welcome to the forum.

Sorry to hear that you are having problems. You should not now be chased for money.

Was this debt included in the IVA?

Hi Anita,

Did this company just start chasing you when your IVA had completed?

If the debt was not included in your IVA then they would have been free to chase you for the last 5 years.
If they have not chased you for the last 5 years then I would assume it was included in the debt and as such you should not be chased for it now!

Have a word with your IP company to make sure that this company was included.

You should have received paperwork stating which creditors have been paid. If this company is there then they have not got a leg to stand on.

Hi Anita

It might be an idea to ask your former supervisor to write to them (or to you) specifically confirming that this creditor was included in the debt)

If they have not received any dividends it could be that the supervisor wrote to them but did not receive a reply and they were then excluded from the dividend - your former supervisor should be able to give you more details

Thanks everyone, I'm 99% sure they were included, the problem I have is that it (the IVA) was started with Debt Matters, then Grant Thornton took over, I have had my completion cert for over a year now and when I call Grant Thornton they just say by law all I have to do is send them a copy of my completion cert, which I have done 3 times now! they never get back to me, so I have to end up calling them and they just say they will take me to court. I have spoken to CAB and they say the same as Grant Thornton, and to be fair since I completed the IVA I have had about 5 debt chasers and I have sent them a copy and they have closed the account, it's just really getting me down, I can't belive I wouldn't have included them as they were one of my more significent debts!

You may like to consider a complaint to the Financial Ombudsman - which usually does the trick to banks who don't listen to what their customers are telling them.

Yes, I did tell them that I was going to do that today, the man on the phone just said 'fine' :-(
I think I will, I haven't got anything to lose have I? Can I find an address on the web?

Thank you so much Melanie! you have already been so helpfull, I have been struggling with this for 5 months!!
Thx Helen, I will get onto the letter today, I have just read Martins Money tips and he says that you should have proof that you are trying to settle the dispute, luckily I have saved all correspondence, do I ask them to send me a final letter saying that they will not close the account and intend on taking me to court?

I would go straight to the Ombusdman to be honest - it seems like you have tried enought times to get this resolved.
