I have recently moved to Australia but although keeping in touch with debtors have now heard from Fairfax Solicitors re an AA Unsecured Loan for which I already had a payment plan in place and have been keeping to. I have now agreed to up my payments and am waiting to hear although have been threatened with all sorts including having to go to court in the UK. Can they make me attend even though I don't have any money for the airfare and what happens if I am supposed to attend and don't?

Hi Marilyn and welcome to the forum. Are you in a debt management plan?

If you can't afford the air fare then I don't see how they can make you attend.

I'm not sure about this though so will keep it bumped up for a professional opinion. x

Depending on whether you feel there are grounds to defend any potential action you could simply communicate via letter to the court.

Not sure what Fairfax are looking to gain in court action unless you have assets such as a house in the UK which they could secure a charging order. No other remedy they could seek would really have any impact unless you were looking to return to the UK some time soon.
