Morning all, well I spoke to the lady from CCCS today and as it stands without claiming housing benefit and being realistic on our budget we do not have enough money left over for an IVA. When and if HB is granted we would be able to go ahead, probably without the need to sell the car. She suggested that between now and then we offer token payments.

She mentioned that if my husband and I sold our car and raised enough cash to get our individual oweing to under 15k we could apply for a debt releif order.

I am now very confused and do not know what to do :-(

Seems very strange and I certainly would not be advising my client to pay off some creditors and put the rest into a DRO. It may be worth taking a second opinion as you do not want to do anything that could cause you major problems.

If you are entitled to HB an IVA can be proposed with the payments to rise when the award is finalised. This gives you protection from creditors but it would be helpful to have some evidence that the award is due.

We are with cleardebt who do IVAs with low DI. They have been very good with us and would be well worth a phone call.

Loopy, look at some of the reviews of IP`s on iva.com, pick 2 or 3 you feel happy with and give them a bell. See what other PROFESSIONAL opinions on your situation are, THEN make your decision on which way to go and who with.
For what my opinion is worth, I`d recommend speaking to Melanie Giles for some no-nonsense,non judgmental, obligation free advice...Don`t panic, there is a solution and it will be found.

Hi Loopy81, it can be very confusing being told different things and not knowing what to do for the best. As the others suggest give 2 or 3 companies a call and get further advice and don't commit to anything until your are clear and happy to move forward. I would also agree with Michael against the advice to clear some debts in order to apply for a DRO.

Hi all,
I have had a busy day chatting to a couple more IP Firms, I settled on one but had a funny feeling about it so got my husband to do some reasearch into them they do not appear on the IVA.com website and have really bad reviews, so I contacted Cleardebt and they are willing to helo me gain an IVA and I feel a lot more positive with them, so will be phoning the other company back tomorrow and telling them I will not be proceeding with them.
I am gathering all the paper work and drafting token payment letters. I am away nexy week camping with the kids, so the week after that is all systems go.

Glad you've tried a few. As I said, we're with cleardebt and they have been fantastic - really helpful and non-judgemental. I'm sure they'll do all they can to help you.
