Hi my husband and I are currently under an IVA which started June 2009 and we had a mortgaged property between us. My husband left June this year and although we have been paying the IVA since he has left, he is now off sick from work. If he fails to pay his part of the IVA and he goes bankrupt will I be forced into bankruptcy because I am living in the mortgaged property? The debts under the IVA were unsecured debts.

Hi Hun, sounds like you need to have a chat with your IP. They will be able to advise you properly and hopefully put your mind to rest.

Your IVAs can be separated and your husband could go bankrupt and you continue on. This will depend on what is best for you all and your IP will be able to help.
