Hi All,

I would like to say hello and i am so glad i found this forum - just from reading the posts and knowing that i am not alone is a great feeling!!

Our IVA started this month which is a great relief and things are looking a lot better than they did, however one thing i have noticed during these bad times is that as soon as you get over 1 hurdle there is another one straight ahead!

This weeks hurdle -
For the last 5 months i have been late paying council tax however they have always received it that month (but just not on the 1st) - I was on a payment plan as 2 payments at different times last year were very late - i was 2 day's late paying my last payment they have now lost patience and have sent me a court order as well as £80 fees -
Because i am on an IVA - will this help my case?
Has anyone had a similar problem - am i crazy to stand my ground and explain in court our circumstances (i am self employed, wife part time because of kids and i get paid different times of the month), i can keep on paying the £150 as part of the payment program (however i think that is now void as i have broken the agreement)
Or should i just pay all the outstadning dept in one go (£400)(which i currently do not have but i suppose i can beg/borrow/steal) as they will not give a damnn and take action??

Hi and welcome.

Firstly, congratulations on having your IVA approved and glad you are doing ok.

I would certainly speak to the council and mention that you have been having problems and have had to take out an IVA, it may make a difference.

What sort of court order is it?

Council tax can be a tricky one as it is a priority debt.
You could argue your case but I think that it won't get you anywhere. You could also speak with your IP as technically if you were in arrears with your council tax that part could have been included in your IVA.
However it may be simpler to bite the bullet and just get it upto date and have a fresh start for the next tax year

The arrears should have been included in the IVA as Andy says so you should notify your IP and have the debt bound in now. It is a relatively small amount in relation to a total IVA debt but a large amount to have to find.

Get your IP to send them a copy of the IVA with a proof of debt and make the future payments on time.
