Hi, my wife and i completed our iva early in May last year and we still have certain elements on our credit file that state Status: Default, and then Balance, with a figure.
Some of the files say Default and then satisfied.
Considering we paid the iva off early in 27th May 2010. The IVA was started in NOvember 06.

My question is when it says a balance and not satisfied, would i be able to apply for a credit card or is this impossible ?
Also when would it be removed from my credit file ?
Those who dont seem to have updated there credit records ar hsbc, lloyds and mint.
Please help me so i can clear our names finally

because i am still in the 6 year period would i be able to get a credit card ? eg vanquis or something like that ? what are the chances of acceptance for a card like that ?

Hi,

You can try and apply for a credit card, some people have been accepted, others not.

If you have any defaults registered after the date of IVA acceptance then you need to write to those creditors and get them to remove the defaults.

Anything before than date will drop off after six years.

The IVA will remain on there until November 2012.

we also have defaults against our name for natwest,egg, max recovery and capital one

where do i get addresses for these companies and what do i write in a letter to them ? any samples around ?

If you look at the websites for the companies then you should find an address for them on there. Just explain what has happened and tell them to remove the defaults. Enclose a copy of your completion letter so they can see that the IVA has been completed.

there is so many departments though and normally letters just get lost if not addressed properly. With so many companies i would need to ensure address are correct

The defaults and IVA's will stay on your credit file for 6 years from when they were first registered. So these should drop off In November 2012.

Until such time you may find it difficult getting any credit from the main banks. Although as Jan says some have been lucky in this respect. Personally I'd leave it until your credit file is back to normal and then apply to your bank.

You can insist that the credit card company update your credit file to show that no money is due, after you get your certificate of completion as the information is no longer factually correct. They have a obligation to do this under the Data Protection Act.

You can also insist that any defaults registered after the date your IVA was agreed are backdated to the date your IVA came into effect.

In terms of the best person to write to for this, you need to find out who the Data Controller is for the creditors with incorrect information at the Credit Reference Agency and write to them and not Customer Services who probably have not got a clue about their obligations under the Data Protection Act.

To find out who the data controllers are, and their address you can do a search on the Information Commissioners website www.ico.gov.uk

there is nothing written on my experian report with addresses, maybe because its online i dont know

thanks but that site doesnt have any addresses on contact names on it
f it was just 1 i would call up, but doing that for 7 or 8 knowing how useless banks are i woudl be going around the switchboard way too much

I have just gone onto the link, entered 'Egg' and it has brought me up a list, I clicked on the correct one and it bought me up the details for Egg.
