Can someone please tell me if my name will be removed from the register in year six after starting in an IVA? I have a clause in my IVA to say that if I couldnt release equity in year five, that I would have to complete another twelve months. However my IVA company is insisting that I complete another two years, not one. They say that they wont ask my creditors for the extra year and will just let it fail if I dont agree to two. If we have to complete seven years, does that mean that at the start of year seven, my name will be removed from the register? Thanks[:(]

Have you had to reduce your payments? Your ip cannot just extend your iva like this. Check your paperwork and be prepared to argue the toss!

Hi Paul

no I havent had to reduce my payments, in fact they have increased in year two and three. I have tried arguing with the IVA company, but they just ignore my side and keep insisting that I have no option. It clearly states in my paperwork that the creditors have the option to increase the IVA so that it runs for 72 months. I am getting really depressed about it all. They asked me to fill out an expediture even though I only filled out the last one in September 2010. They have now come back and said that I am not allowed the amounts that they had agreed for the last four years. I am really confused.....

This doesn't sound right at all Saintsgal and I don't really know what to suggest. Has this information come from your IP or somebody from the office.? I would suggest you demand to speak to your IP directly.

The only contact I have had is from my case worker. I think they only took over in Sept as the previous contact seems to have disappeared. They claim that they can't find any of my paperwork, even though I got a confirmation e mail at the time of submission. I have re sent it again along with the new I&E form, but am not too hopeful.I am worried about rocking the boat in case they make my IVA fail as they have threatened.

Hi and welcome.

Which company are you with? You should perhaps try speaking directly the IP rather than a caseworker. Sounds like a breakdown in communication here.

As regards the Insolvency Register, you won't come off that until the IVA is completed.

Hi there & welcome from me too,

As the others have said please get onto your IP as they can not just extend the IVA without good reason too.
