Hi all

Just a quick question as I got my annual credit report today - not that it matters as still have 3 years to go but I like to have a nosey.

On it it shows that MBNA made several default notices for around 12 months after my IVA started... and Capital One are still defaulting me every month up to today!

Whilst this isn't an issue now - am I right in assuming they should not be doing this?

Also when it comes time in 3 years to do the housekeeping ... to whom do I write to get these defaults removed?

Know its ages off but I am a planner lol! [:I] x

Hi Til,

They can do it whilst you are in your IVA but as soon as you complete then they have to remove any defaults added after the date the IVA started.

You will need to write to the data controller for each creditor concerned enclosing a copy of your completion letter and insist that they remove those defaults.

Ah thanks Jan - wasn't sure if it was the credit agencies that I wrote to.

Good to know they aren't doing anything they shouldn't and will look forward to writing to them in 3 years lol!

I shall be doing the same when mine finishes - one of my companies was defaulting me every month but I've not checked for a long while now so no idea if they still are!!

It's something I will need guidance on when my IVA concludes as I haven't got a clue, so I'll be turning to my forum buddies. x

its a long way off but when the time comes, i will need help with this too, the good thing is i know just where to come to get it :-)

Same here, I had no idea this site existed until a couple of days ago, my best accidental find yet. [:)]

It's been so helpful to talk with people who also have IVA's and know the pitfalls.
