Hi All,

I'm new to this & was wondering if anyone can help?

I finished my IVA this Jan 2011, I got my completion letter in April this year.

I've just got a credit report from Experian today & 3 of the creditors default dates are after the IVA start date. one even says April 2007. Am I right in thinking that these need to be changed to Jan 2006 (the start date of the IVA)

Also none of them say satisfied / settled, looking at these they seem current is this correct?

If anyone can tell me what I shall do nect to get these up dated that would be great. I thought of contacting Experian but I really don’t have a clue on what to say

Paul - I'm not sure that it's worth doing anything until the 6 years are up (ie Jan 12) as this is how long the IVA will show. By then some of this may be cleared up? Someone may be able to give more advice here later but I don't think I'll be looking at mine until the year after it ends.

On the report it say that they'll last 6 years after the default which is good on some but these 3 would mean that my credit file won't be clear till 2013 as that's 6 years after the last default

I just thought I'd get it sorted now before the Jan 2012

Hi Paul and welcome to the forum.

Now you you have your completion letter you should find out what your credit record holds. Get copies from all three agencies, if any creditors have defaulted you after the date of acceptance of your IVA then you need to write to them and get them to remove the defaults.

Your IVA will remain on there for the full six years though.

They have to remove defaults registered after the date of IVA acceptance.

I think you can write to the Data Control office of each of the companies and inform them that the Information Commissions Office advise that the defaults should not be added if they are post date of the IVA agreement. I have some to contact too, my agreement date was 12th July and have some defaults stating that they defaulted in the September / October, so these need to be removed. Haven't got round to doing this myself yet. I do stand to be corrected by the more knowledgable people on this forum.

Kallis, if the default has been put on post IVA acceptance date, do I need to wait for the certificate of completion, as this could be another 3 months yet. Can I just write and ask for these details to be removed as they breach the Information/Data control rules.

You do need to wait for the letter as your IVA is not technically completed until that date.

Breezerboy, I was in a very similar position when I completed last year, 3 creditors defaulted me after my IVA started, after contacting all of them 2 corrected except 1. I asked equifax but they are others to contact them which they did and it was corrected very quickly, so my advice is let the credit agencies chase up your creditors on your behalf, its so less stressful.

The standard letters on here do the trick. Be relentless in your efforts and make sure the data is correct at all 3 CRA's.

Time and patience is needed though I am afraid. Always follow up, if you hear nothing or get the standard bogg off letters.
