Hi all.
I have been in an IVA with my husband for the last 3 years. I am probably about to lose my job after being accused of something I did not do but cannot prove.
If I do lose my job I will be persuing unfair dismissal. At the moment I am suspended on pay. I just dont know what to do.
As the charge is gross misconduct I feel I will find it very difficult to get another job with the same pay and just cannot see anyway forward.
There is no way that without my wage we would be able to keep up with the IVA payments.

Sounds awful. Julie who posts on here is a bit of an HR guru and may be able to help with the situation.
Regards your IVA, you need to speak to your IP as soon as you get a chance to see how they can help. Could you manage reduced payments into the IVAs?

Hi DDD,
Julie is an HR wizard and may be able to help with the gross misconduct charge. She is very good to posters with HR problems and has helped lots of people in the past.
Re your IVA, you need to speak to your IP soonest to discuss the options open to you. Would you be able to make reduced payments?
Will you get a payout you could offer in f&f? If they are manufacturing a case with scant evidence they may pay you to go quickly and quietly. My OH has has paid out up to six months salary before now when a case can't be resolved.

Thanks all.
It is highly unlikely that any payoff will be forthcoming. I am still hoping that all will be resolved and I will be back to work soon (So are all my work collegues) but just have a feeling it is not going to be.

Just found out thet my meeting due for tomorrow will not be done till next week now as they have not sent me all the paperwork they should have.

Hi - without knowing the details, my first suggestion would be to gather as much information as you can which may indicate that you have not committed the act you are being accused of committing, including the names of people who will back you up. Look at the scenario from the investigators' point of view and try to think of how you can explain what really happened, as opposed to what they think happened.
If, at the investigation, you present yourself as organised and confident, you will be listened to, if your employer is reasonable and they haven't made their minds up already.
If they have made their minds up already - that's a whole other conversation and potentially not the end of the world. More details would be required.

I need copies of notes from previous meetings to make sure there are no errors listed. Also supposed witness statements which I have not yet seen. All my work colleagues are behind me and I have there full support. They say it could have happened to anyone of them.

Sorry - I was on a totally different plan when I posted that, I thought you were on about a creditors meeting, not the one for work.
I do hope that this all works out in your favour. They will have to let you see statements - do you have a union rep that will be going to the meeting with you?

Yes the union rep will be with me. It was him that got it postponed. I just feel so stupid that I cannot remember even serving the customers that have made the allegations. I have been on anti depressants since Feb and really don't need all this hassle. just struggling to cope at the moment.

When you see their documents, I'm sure you'll be able to weaken their case (even if you can't build a counter-case) and leave them in sufficient doubt that all isn't as they think it is. Good luck x
