Well, today I have a letter from Santander telling me that they are terminating my loan agreement with them and will be selling my debt on to a debt collector to pursue payment, so does this mean I am now going to start getting hassled by someone else over this debt? I though all this stopped when you had an IVA? I am now at the end of my tether with it all[:(]

The company buying the debt will likely get in touch at which point you can point out the debt is included in the IVA and give them your IP details and inform them that if they contact you further you will take legal action against them for harassment. Any others that are hassling you can be given the same threat.

I wouldn't worry about it. A few of my debts were sold on and all that happened was I got a letter from the DCA confirming this. Any problems and your IP will contact them.

Nothing to worry about lem. Even if you do get letters, just forward them on to Mel and let them take the strain.
You are covered.

It amazes me how many debts are sold to DCAs who don't seem to be aware that an IVA is in force. But then, I guess they buy them in "job lots" and the pittance they pay makes the risk worthwhile.

To be honest, I have never had any hassle but if I did, apart from the annoyance factor, it wouldn't bother me. I'd be telling them where to get off in words of one syllable.
They can't touch you so just let them get on with it.

Hi, been wondering how you are doing!
we've had letters a bit like this, it means nothing now as long as it's included in your IVA,just forward them onto Mel's team- it worried me too.
we've just had more letters from Lloyds telling us they've amended the terms& conditions on our bank account -dugh! that account formed part of our IVA debts,the IVA was accepted in Feb this year!
how are you doing apart from this?

hi lem its easier said than done. i still get all the junk mail and calls 3 years on but i dont let them bother me anymore. just forward to your ip or get a cheap shredder fd xxx

thanks raffles66, it takes a while to sink in that it's all delt with. it seems such a waste of paper & man time to me too.
flumpy dog, 3 years on is a long time to be still getting calls! hope you've got a sturdy shredder! lol!

my hubby had a loan with abbey which was included in his IVA and it was sold on to capquest never had any problems they just sent a letter say they had taken over the debt.
they have defaulted him on his credit report though but abbey haven't and they have put debt settled.

Hi all,
Yes its me again, popping in to say hello. Also with regards to letters and phone calls, once my IVA started they stopped and it has been heaven not waiting for mail to pop in the letter box. A lot of my debts where sold on and they do send a statement once a year detailing how much has been paid from my IVA company.
I am now near the end of my IVA which should have been 1st Sept 2011 however the IVA company say I still owe one payment, but I am disputing that and have sent a email to GT to recheck my files. Still waiting for a reply.

point them to Mel and her team will sort them out for you Lem, don't let them bother you, you're well protected within your IVA x
