Hi has anyone received a refund from HMRC whilst in IVA? My sister has received a cheque for £249 and is just starting second year of IVA can she keep all the cheque or should some be paid to IVA?

it depends on her agreement if there is a windfall clause in there then yes, she should consult her IP

If she has the windfall clause of £500 then she should be ok to keep this money.
Get the paperwork out and have a read through to see what it says.

Thank you; it says 'after aquired assets' means any asset, windfall or inheritance with a value of more than £500. The clause then says the supervisor may claim as an asset of the arrangement any after aquired assets...Does this mean she is ok to keep it as its less than £500?

I believe that my sisters IVA is with Melanie Giles company if Melanie or one of her collegues wouldn't mind answering this post and the pay rises one if they get chance. Thanks for everyones help.

It would be better if she or you contacted us directly. I would never give case specific advice over a public forum, without knowing the full facts.

If your sisters IVA is with Mel and her tean she will already have access to a wealth of contact numbers and e-mail addresses for the team; including her own case manager. Speaking from personal experience I can assure you that no question is too daft for them to take on (even if the person asking it is) and your sister will be given accurate and timley advice which will ba case specific. I would doubt that the team would in fact discuss specific detail regarding someones case unless it was with the person themselves due to confidentiality. Good luck

Always better to check directly with your own company,but worth asking on here too,so people know when there case worker isnt being as straight as they could be!!(not all companies are as good as some that post on here!!)
