put a claim in for ppi wich was with first plus.my question is, it was secured against our home wich my wife and i both paid but it was only in my name, can my wife keep half as i am the only one with the iva.it was a joint mortgage so dont know how it is just in my name as my wife would have to sign it if it's secured on our house!

If the loan is only in 1 name I think you are stuck, regardless of the property being in 2 names.

Agree with Paul - if it is just in your name then it will have to be paid into the IVA.

we moved mortgage provider in 2004 and payed are old mortgage off plus the secured loan which had ppi so you would think she is entitled to half as we both paid the mortgage since

Unfortunately, if it is just in your name then she is unlikely to get a look in.

Have a word with your IP.

It is very unusual to see a secured loan taken out in just one name. Are you sure that this is correct?

Hi Jar

I have just received a cheque from firstplus for ppi. The cheque is in my name, but similar to you, it was a secured loan with my partner and I am the only one in the IVA. Going to contact IP tomorrow, to see if we can keep any of the money to buy a new cooker (two rings and oven not working properly), get stair carpet and other minor repairs and decoration. Maybe as the loan is in both are names they will only want a percentage. Will keep you updated.

Hi

If the loan is joint and hence the PPI payment then any refund should be between you and the non IVA party should be able to keep their share of any refund.

Your wife can definately keep her share. Glad we were able to help with this one, and it should prove to be a good Xmas in the "Jar" household!
