Hi Wonder if any one can help coming up to 1st review notified supervisor when I had a wage rise and bonus and they asked me to do a i & E form spoke to them today and they have now stated must pay half of everythink back i knew this was the case but they have just left it till 1st review also partner recieved tax rebate last year and was told he could keep it which we questioned loads of times we entered iva end of feb and he recieved april so basically it was the year he worked prior to iva apart from six weeks i hope someone can help and how will we repay

Hi parjay - you'll need to check your proposal. Ours states we have to inform the IP (as you did) but that it will only take effect from the review date. If yours says the same I would query it again (I think you are with the same IP as me if I remember rightly - McCambridge Duffy?).

With regards to the tax rebate, I think that should have been paid to the IVA pot at the time. If you have disclosed this several times and they have not acted on it then I would hope they would let you pay it to them over a few months to make it easier.

Hi Parjay
Please be advised that only when the annual review has actually been conducted can we advise if there is any money owing in respect of overtime or bonuses. In the event that there is monies owing and you do not have the funds available in a lump sum then you can extend your arrangement by up to 6 months in order to address this. So that I can advise you further on the tax rebate can you clarify when the tax rebate was received and for which tax year it was for as you may be entitled to retain this money.

Always back up things said on the phone with letter or even email so you have a record of what was said as we often hear of case managers/supervisors changing their mind over what has been said.

hi thanks for replies as for tax it was recieved in april 2011 from april 2010/2011 we enterted into iva feb 2011 but my partner asked this question on many occasions also my partner pays £200 per mth fuel and cus he is self emloyed he cant claim fuel supervisor is stating basically that he cant claim for it ?

Hi Parjay

There appears to be some confusion in relation to the tax rebate issue and so that we can fully advise you on what should or is to happen with the money you received can you please contact my office directly and provide a copy of the correspondence issued to you from HM Revenue and Customs.

To clarify the fuel issue, any increase in your personal fuel usage can be declared on your personal income and expenditure form required for your annual review.

If your partner has had an increase in his fuel usage for his self employed business then this must be claimed as a business expense and not a personal expense to yourselves.

The overall effect of this may be that his net take home pay is reduced which is likely to have an impact on your personal income and expenditure. If this is the case then when conducting your annual review we shall discuss if a reduction in payments is required and also how we go about implementing this change in your arrangement.
